Terms of service

These Terms of Service govern the use of japan-apparel.com and purchases from Japan Apparel 合同会社 (“Japan Apparel”, “we”, “us” or “our”). By using the website or placing an order, you agree to these terms.

2. Products and Pricing

Product descriptions, availability and prices are shown on the website. Quantity-based pricing may apply. There is no general minimum order unless stated for a specific product or custom order.

We make reasonable efforts to ensure that information is accurate, but may correct genuine errors before accepting an order. Product colours and appearance may vary slightly between screens and production batches.

3. Orders

An order is an offer to purchase. An order is accepted when we confirm acceptance or dispatch the products. We may refuse or cancel an order before acceptance because of stock availability, pricing or listing errors, suspected fraud, payment issues, shipping restrictions or other reasonable operational grounds. If payment has already been collected for an order we cannot fulfil, it will be refunded.

Customers must provide complete and accurate billing, delivery and contact information and select the correct products, sizes, colours and quantities.

4. Payment

Available payment methods are displayed at checkout. Payment is due as shown during checkout and is processed through the selected payment provider. Customers are responsible for any fees charged by their bank or payment provider.

5. Shipping and Delivery

In-stock website orders are normally handled within three business days. Typical transit time is three to eight business days, with the available service and estimate shown at checkout. These times are estimates and may be affected by carriers, customs, weather or events outside our reasonable control.

Standard shipping is offered to supported destinations in Oceania, North America, Europe and Asia. Other destinations and large-volume shipments may require prior arrangement.

Risk of loss and responsibility for the products pass as provided by the applicable shipping term and mandatory law. Customers must inspect delivered shipments promptly and report visible damage or discrepancies without unreasonable delay.

6. Duties and Taxes

Unless expressly stated otherwise, import duties, customs charges, destination taxes, brokerage fees and similar charges are the customer’s responsibility. Japanese consumption tax is not applied to qualifying export sales outside Japan. The final tax treatment is determined by the destination, order circumstances and applicable law.

7. Cancellations, Returns and Defects

Our Refund Policy forms part of these terms. Except where required by applicable law, we do not accept change-of-mind returns or exchanges for non-defective products. Verified defective, damaged or incorrect products will be handled in accordance with that policy.

8. Custom and Production Orders

Specifications, quantities, pricing, payment requirements and production schedules for customised or large-volume orders are agreed individually. Once confirmed and production has begun, these orders cannot be cancelled, returned or exchanged except where products are defective or materially different from the agreed specifications.

9. Acceptable Use

You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, use it for unlawful purposes or infringe the rights of Japan Apparel or any third party.

10. Intellectual Property

Website content, branding, photographs, designs, text and other materials are owned by or licensed to Japan Apparel and may not be reproduced, distributed or commercially used without prior written permission, except as permitted by law.

11. Liability

To the fullest extent permitted by law, Japan Apparel is not liable for indirect, incidental or consequential loss, loss of profit or business interruption arising from use of the website or products. Nothing in these terms excludes or limits liability or customer rights that cannot legally be excluded or limited.

12. Events Outside Our Control

We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, customs action, natural disaster, epidemic, conflict, labour disruption, government action or failure of communications or payment systems.

13. Governing Law and Jurisdiction

These terms are governed by the laws of Japan. To the extent legally permitted, the Osaka District Court shall have exclusive jurisdiction as the court of first instance. Mandatory rights and jurisdiction rules that apply to a customer remain unaffected.

14. Changes and Severability

We may update these terms by publishing a revised version on the website. If any provision is found invalid or unenforceable, the remaining provisions continue in effect.
